Our Divorce Process
We like to understand all of the facts and the desired outcome at the beginning of a case to give the best legal counsel for your divorce.
Our divorce attorneys create a Petition for Divorce.
The person initiating the divorce must then give legal notice to their former partner. Our divorce attorneys can help identify the best way to give legal notice.
The couple then determines the type of divorce: no fault or fault based. Community property, asset and debt distribution, custody arrangements, and spousal support decisions will need to be determined in advance of the final divorce papers. Our divorce attorneys work with you to understand what you’re owed and how to negotiate for a positive outcome.
In the event that the two parties cannot decide, we’ll represent you in court and strongly defend your case. We’ll explore every legal avenue to ensure you and your family are protected under the law.
Divorce Types in Texas
We Fight for What Is Fair
While rare in Texas, spousal support can be awarded by the court if the following applies to you:
- There was documented violence committed against you or your children by your spouse within the last two years
- You are in the process of becoming a U.S. citizen
- You and your spouse agree to spousal support after the divorce
- The marriage lasted for over 10 years, you lack income, and you are either disabled, the caretaker for your disabled child, or unable to provide for your minimum needs
